Paris attorneys, François Jonquères and Louis-Marie Pillebout co-authored the article “Where legal truth can differ from scientific truth.” The article comments on a French Supreme Court decision. In an important reversal of precedent, the French Supreme Court opens the door to indemnification of victims of nervous system disorders suspected to have been provoked by a hepatitis B vaccination. The Supreme Court holds that lacking scientific certitude of the link between the vaccination and the development of the nervous system disorder, the existence of legal causality can nonetheless be recognized on the basis of a simple presumption of fact.
