David Walters is a Partner in Howrey’s Securities Litigation, Government Enforcement and White Collar Defense (“SGW”) practice group. He is also a Partner in Howrey’s Class Action and Product Liability practice groups.
Mr. Walters’ SGW practice focuses on complex commercial litigation, and international and domestic regulatory compliance and enforcement. He is an experienced trial attorney for international and domestic corporations and senior executives, with trial expertise in the areas of corporate fraud, securities and tax fraud, class actions, product liability, market valuation and penetration, contracts, and pharmaceutical fraud. He has conducted multi-national negotiations with governmental entities in civil and criminal matters. He has served as National Coordinating Counsel for domestic and international corporations managing multiple litigations. Mr. Walters is also well known for his defense of entities involving claims of civil RICO, and in defending corporations seeking to prevent class certification in securities cases. Mr. Walters has also represented multiple companies in negotiation and litigations involving government contracts, including debarment challenges and fraud investigations.
Mr. Walters has extensive experience in evaluating compliance programs. He provides counseling to corporate clients as to the adequacy of due diligence and as to potential fraud risks in the execution of overseas operations. Mr. Walters is part of the Howrey taskforce on FCPA/OECD issues, and has provided training and advice to corporate clients for background awareness and prevention of potential violations.
Recently, Mr. Walters was part of a small team representing the former publisher of the Chicago Sun Times, and former President of Hollinger International, a large multinational newspaper organization. Mr. Walters represented this executive in negotiations with the US Attorney’s Office, the SEC, the IRS, and assisted foreign counsel in negotiations with international criminal bodies. Mr. Walters also represented this individual in litigations against his former companies. Mr. Walters negotiated with corporate special committees which included former SEC chairman, Richard Breeden. He represented this executive in civil litigation in many US and foreign jurisdictions, including in lawsuits in Chicago alleging advertising fraud. Mr. Walters represented this executive at the grand jury and in preparation for his testimony as the key witness at the Conrad Black trial.
Mr. Walters also recently represented David Hicks, an Australian national detained for over three years without trial in Guantánamo Bay, Cuba, in a military commission case. Mr. Walters obtained security clearance and helped Major Daniel Mori, USMC and military commission defense counsel, to prepare David Hicks for military commission trial. The team successfully obtained the repatriation of Mr. Hicks to Australia in 2007. Mr. Walters recently has written and spoken on issues faced by the Obama administration in redevelopment the military commission process.
Mr. Walters has written amicus briefs for the US Supreme Court on behalf of the American Bar Association, on the issues of necessity of investigation by death penalty counsel, and the need for expert testimony in cases in which eyewitness examinations result in convictions. He has spent significant time counseling clients on health care fraud and abuse issues, and has prepared articles for the American Medical Association and other entities on healthcare compliance and litigation issues.
Mr. Walters is a member of the ABA, the ISBA, the National Association of Criminal Defense Lawyers, the Constitutional Rights Foundation, and the Chicago Inn of Court.
