Todd Wagnon’s practice focuses on resolution of complex design and construction disputes on industrial, commercial and government projects in the United States and abroad. He has advised and represented prime contractors, owners and developers in pursuing and defending claims for changes, delays, disruption, differing site conditions, and design and construction defects during all phases of the disputes process. Through his involvement with government construction projects, he has experience addressing not only the traditional construction claim related issues but also the complex and unique legal questions that arise when contracting with the government. In addition to litigating matters in state and federal courts, he has extensive experience in resolving disputes before domestic and international arbitration panels.
Representative Highlights
- POSVEN Hot-Briquetted Iron Plant – Puerto Ordaz, Venezuela. Represented EPC contractor in disputes with the owner, process supplier and erection subcontractor arising out of design and construction of process plant. Matter involved three international arbitrations, US District Court litigation and Venezuelan litigation.
- Accelerated Closure Project – Oak Ridge, TN. Represented prime contractor in disputes relating to environmental remediation and decontamination and demolition projects at US Department of Energy facility.
- E. Barrett Prettyman Courthouse Annex – Washington, DC. Defended prime contractor against window supplier’s claims under the Miller Act for unpaid and extra work.
