Enforcement and Litigation When an offending party receives a "cease and desist" letter on Howrey letterhead, the full strength of Howrey’s litigation brand is evident: we get results for our clients. And we do so as quickly and cost-effectively as possible. In many instances, trademark matters are resolved favorably for our clients with minimal litigation and without the time and expense of a trial.
Howrey’s representation on behalf of a corporate entity may include stopping an individual or entity from using a protected famous mark; negotiating with a trademark infringer to license a client’s trademark and agree to pay royalties; or working through clearance for a new product. When settling a trademark dispute is not an option, inside counsel trust Howrey to enforce or defend their companies’ trademarks before government agencies or in courts at home or abroad.
Our attorneys also pursue infringement and anti-counterfeiting actions through customs and the International Trade Commission (ITC). In a recent anti-counterfeiting case, a Howrey partner obtained a seizure order, raided a warehouse along with US Marshals, inspected and seized the counterfeit merchandise and won a court order to divulge the source of the contraband.
