Scott Schutte is a Partner in Howrey's Chicago office and a member of the Global Litigation practice group. He practices in all areas of commercial litigation, but focuses primarily on class action defense and insurance coverage litigation.
Mr. Schutte has defended consumer services providers, product manufacturers and banks in high-exposure class action lawsuits in state and federal court throughout the United States and in the United Kingdom. Mr. Schutte also has pursued claims for insurance coverage on behalf of policyholders in a variety of industries – ranging from computer manufacturers, railroads and oil companies to speciality mineral suppliers, banks, and owners of hotels and small businesses – in the US and throughout the world, including in the UK and Cayman Islands.
Mr. Schutte has had first-chair responsibilities in several jury trials, arbitrations and mediations. His first-chair experience includes a jury trial over insurance coverage for a trade dress claim, and an international arbitration over the attempted rescission of a property policy after a hurricane loss. He also has been on the trial teams for a jury trial that resulted in one of the largest defamation verdicts ever in the state of Tennessee; an arbitration relating to insurance coverage under a directors and officers policy; and a jury trial relating to insurance coverage for alleged brain damage based on exposure to cleaning solvents.

Representative Highlights
- Cayman General Insurance Co. Ltd. v. Divi Hotels, Inc. Served as lead counsel in an arbitration hearing in the Caymen Islands regarding policy rescission and property coverage after a hurricane; obtained a unanimous ruling that the insurer did not have the right to rescind the policy for alleged misrepresentations in the application.
- CSX Transportation v. Admiral Insurance Company, et al. Jury trial regarding insurance coverage for employee solvent claims.
- Degani et al. v. The Community Hospital. Acted as lead counsel in a preliminary injunction hearing regarding a non-compete clause in an employment contract; defeated a motion for preliminary injunction.
