Michael Padden is a litigation Partner in the firm's Chicago office. His practice includes a broad range of business litigation, with special expertise and experience in the areas of antitrust, intellectual property, contract disputes and business torts. Mr. Padden has tried cases in state and federal courts throughout the country, as well as before numerous arbitration tribunals.

In the intellectual property area, Mr. Padden has successfully prosecuted and defended patent infringement claims in a variety of settings, including mechanical patents, business method patents, and Hatch-Waxman litigation. He has also successfully defended and prosecuted claims of misappropriation of trade secrets. In the antitrust area, Mr. Padden has tried cases involving claims of monopolization, attempt to monopolize, price discrimination, exclusive dealing, division of markets and restraints of trade in a wide variety of industries, including healthcare, gas transmission, beer distribution and telecommunications. Mr. Padden has also successfully represented clients in a wide variety of commercial litigation involving breach of contract, breach of fiduciary duty and other business tort claims. His experience ranges from the defense of a major mining equipment manufacturer against a multimillion-dollar claim based on allegedly faulty load data to the successful prosecution of an action to collect rent based on a disputed percentage rent provision.

Representative Highlights

  • United States Gypsum Company v. Pacific Award Metals, Inc. Represented the plaintiff in an action to enforce patent and trade secret rights regarding coated paper-faced drywall corner bead technology, inducing settlement after obtaining summary judgment against a false marking counterclaim and establishing a right to go to trial on the trade secret claim.
  • Andrew Corporation v. Tessco Technologies Incorporated. Represented Andrew Corporation against various antitrust and state law claims arising out of the termination of a distributor, including monopolization, restraint of trade and breach of the Maryland dealer termination statute. Removed the action from state court to arbitration, and resolved the dispute following a favorable preliminary injunction hearing in arbitration.
  • Compagnie Des Bauxites De Guinee v. Hammermills Inc. Represented defendant mining equipment manufacturer in arbitration before the International Chamber of Commerce in Paris against a $46 million claim for damages based on allegedly faulty load data. Obtained dismissal of all charges after a 20-day hearing, and an award of approximately $1 million in fees and costs.
