Marc Schildkraut Rejoins Howrey's Antitrust Practice

Washington, D.C., April 28, 2008… Howrey LLP announced today that Marc G. Schildkraut has rejoined its global Antitrust Practice in Washington, D.C. Schildkraut had been with Howrey from 1993 to 2005, prior to which he spent 17 years at the Federal Trade Commission in various roles, including Assistant Director for the Bureau of Competition. Until recently, he led the Antitrust and Trade Regulation practice at Heller Ehrman. “We are extremely happy that Marc is coming back home,” said Sean Boland, co-chair of Howrey’s Antitrust Practice. “He has done magnificent work throughout his career and we are excited that he has decided to continue his practice here. Marc Schildkraut was the lead attorney in halting two recent Federal Trade Commission attempts to enjoin major acquisitions,” Boland added. “He represented Western Refining in the FTC’s unsuccessful attempt to prevent Western’s merger with a competing refiner. He also successfully represented Aloha Petroleum in the FTC’s efforts to enjoin Aloha’s acquisition of a competing gasoline marketer. Those are major accomplishments,” Boland said. While at Howrey in the 1990’s, Mr. Schildkraut served as lead antitrust counsel for The Bon-Ton Stores, Inc. in a successful private antitrust action that blocked a department store chain’s acquisition of a competing chain. Alan Wiseman who also co-chairs the Antitrust Practice echoed Boland’s sentiment: “Marc is an extraordinary antitrust lawyer. Throughout his career, he has taken on the tough matters- and won. We are happy that he will once again be a part of Howrey.” Howrey’s Antitrust Practice is the largest in the world, according to Global Competition Review’s “GCR 100,” a survey of the world’s largest antitrust practices. The firm recently strengthened its breadth by its merger with Spain’s top competition firm - Martínez Lage. Earlier last year, Howrey added antitrust capability to its London practice with the addition of Tom McQuail, one of the UK’s top competition practitioners and just this month, Lars Kjølbye joined Howrey’s Brussels Competition practice from the European Commission’s Directorate General for Competition (DG COMP), where he was as head of the energy and environment antitrust unit. “I am inspired by Howrey’s transatlantic reach,” Marc Schildkraut said, “and I am looking forward to being a part of that again.” Schildkraut, 56, specializes in mergers, antitrust litigation and civil investigations before U.S. and international enforcement agencies and the courts. In the mergers arena, he has obtained antitrust clearances in some of the country’s largest mergers in which he was the lead attorney, including McDonnell Douglas in the Boeing/McDonnell Douglas merger; Amoco in the BP/Amoco merger; Texaco in the Texaco/Chevron merger; Exxon and Mobil in the Exxon/Mobil merger; PepsiCo in the PepsiCo/Quaker merger; American Stores in the Albertson’s/American Stores merger; Chips and Technology in Intel’s acquisition of Chips and Technology; Comcast in the acquisition of AT&T’s cable operations; Sunoco in separate acquisitions of Chevron’s and El Paso’s Philadelphia-area refineries; Frito Lay in the acquisition of Eagle snack food manufacturing assets; and Royal Dutch Shell in the acquisition of Montedison. He has several notable achievements in litigation that focus on the interface of antitrust law and intellectual property. He represented Intel in oral arguments before the Federal Circuit in Intergraph v. Intel. That case extended the proposition that the withholding of tangible intellectual property does not satisfy the requirements of a monopolization claim under the Sherman Act. He was also part of a team that represented Schering-Plough in litigation before the Federal Trade Commission concerning the settlement of a patent dispute concerning generic drugs. The Administrative Law Judge dismissed the complaint, the FTC reversed, but the Court of Appeals for the 11th Circuit reversed the FTC, handing the FTC a major defeat in its challenges of settlements of patent litigation between brand and generic pharmaceutical companies.
