Senior Associate
Dawn Ellison specializes in complex commercial litigation. Her experience includes class action, contract disputes, products liability claims, electronic discovery, toxic torts and insurance recovery issues. Ms. Ellison has also represented pro bono clients in connection with adoptions, employment issues and fraud claims.
Ms. Ellison currently represents a major oil refiner in multidistrict litigation involving products liability claims related to the use of the gasoline additive MTBE and its alleged effects on the environment.
While earning her J.D., Ms. Ellison was a staff member of the North Carolina Law Review.
Representative Highlights
- In re MTBE Products Liability Litigation. Defending El Paso Corporation in approximately 20 cases in several federal and state courts. Claims brought by State Attorneys General, public water providers and private entities alleging groundwater contamination from gasoline additive.
- Berisha v. Amerada Hess Corp., et al. Defended several oil refiners against multi-state class actions claims alleging economic and future damages resulting from alleged environmental contamination. Case ended when Court denied plaintiffs’ class certification motion.
- International Paper Company and Masonite Corporation v. Affiliated FM Insurance Company, et al. Member of Howrey team that secured a $383 million jury verdict on behalf of International Paper and Masonite, arising out of the refusal of over 20 insurance carriers to respond properly to a nationwide products liability class action. Combined with the $93 million jury verdict awarded in the first phase of the trial (including $68 million in punitive damages), the total jury verdict in the action exceeded $475 million. Case was among top 30 jury verdicts nationwide for 2003.
