Martin Cunniff is a member of Howrey's Antitrust and Global Litigation practice groups and serves as Co-Chair of the firm’s Commercial Litigation and Trial group. His practice focuses on high-stakes litigation for major corporations located in the US and around the world. His practice encompasses all types of complex commercial disputes including breach of contract, securities, antitrust, business torts, fraud, intellectual property, trade secrets and other commercial issues. He has been involved in numerous class actions.

Mr. Cunniff has extensive experience representing clients in arbitration and was the lead trial lawyer in one of the first early resolution arbitrations pioneered by the federal district court in the District of Columbia. He has appeared in state and federal court on both the trial and appellate level.

Mr. Cunniff serves as the Chairman of the firm’s Attorney Training and Professional Development Committee. During his tenure as Chairman, the firm has received several national awards for its training initiatives. Mr. Cunniff has been in the forefront of the change to a competency-based system for associate compensation and promotion.

Representative Highlights

  • Wagner v. Barrick Gold Corporation. Currently represents Barrick Gold Corporation in a securities fraud class action involving gold hedging and operations at various mines around the world.
  • Cable & Wireless v. MCI Worldcom. In a multifaceted dispute resulting from MCI’s sale of its internet backbone to C&W, represented C&W in two arbitration hearings, before the US Department of Justice, the European Commission, and in hearings before Congress. At the conclusion of the various proceedings, MCI made payments and concessions to C&W totaling $248 million.
  • Vidal Sassoon v. Procter & Gamble. Represented P&G in licensing dispute with fashion icon Vidal Sassoon involving shampoo and hair care products. Case settled after summary judgment decision restricting plaintiff’s damages.
