Ty Childress is the Co-Managing Partner of Howrey's Southern California offices and a Partner in the Commercial Trial, Insurance Recovery and Complex Tort practice groups who specializes in complex business and tort litigation, insurance coverage advice and related coverage litigation. He has been recognized as a premier business litigator in guides such as Chambers USA's "Leading Business Lawyers" and Euromoney Legal Guide to the World's Leading Insurance Lawyers. Chambers USA ranks him among the top policyholder lawyers in the country, noting that "he is intelligent, presents well and has earned his peers' respect," and quotes comments from clients that he is "analytical and knowledgeable with great negotiation skills," is an "intellectually versatile and creative thinker," and "when it comes to the crunch, you can rely on him to get results." Mr. Childress has also repeatedly been named by Los Angeles magazine as one of Southern California's "Super Lawyers."
In addition to his extensive experience in complex insurance coverage claims, Mr. Childress conducts an active commercial litigation practice in a wide variety of other areas including railroad, product defect, real estate, environmental, toxic tort, contract, fraud and indemnity disputes.
Mr. Childress was among the trial counsel who obtained one of the largest jury awards in California in the 1990s and has been involved in several landmark court decisions. In addition to a national litigation practice, Mr. Childress has also served as lead counsel in arbitration proceedings across the country and secured numerous multimillion-dollar arbitration awards.
Representative Highlights
- In re September 11th Liability Insurance Coverage Cases. Served as counsel for World Trade Center Properties LLC and Larry Silverstein seeking to enforce insurance coverage rights relating to liability claims arising from terrorism-related events of September 11, 2001.
- Los Angeles County Metropolitan Transportation Authority, et al. v. Union Pacific Railroad Company. Obtained complete dismissal with prejudice of all claims against Union Pacific relating to a rescission and fraud action brought in federal court in Los Angeles by the Los Angeles County Metropolitan Transit Authority over the ownership rights to fiber optic easements throughout the Los Angeles Basin, pursuant to a $450 million real estate transaction.
- Southern Pacific Transportation Company v. Certain Underwriters at Lloyd’s/London. Acted as lead counsel for Southern Pacific (now Union Pacific) in complex coverage litigation against more than two dozen insurers for environmental claims at 63 sites across the Western United States.
