Senior Associate
Alyson Barker is a senior associate in Howrey’s intellectual property practice specializing in all areas of intellectual property law, with an emphasis on patent litigation. Ms. Barker has experience handling all stages of litigation, including developing a case strategy and executing it, managing discovery, drafting substantive motions, working with and managing expert witnesses, conducting mediations and drafting appellate briefs. Ms. Barker has taken a leading role in drafting several successful motions for summary judgment and appeals to the Court of Appeals for the Federal Circuit. In addition, Ms. Barker has experience handling a wide array of technical areas, including medical devices, pharmaceutical products, performance apparel, computer software and printing technology, and wireless communications. Ms. Barker has also handled cases involving design patents, trade dress, and trademarks.
Ms. Barker is also a recognized leader in the intellectual property bar. She is active in the American Intellectual Property Law Association where she serves as vice-chair of the Women in IP Law Committee. Ms. Barker also serves as chair of the Committee for Alternative Dispute Resolution in the ABA IPL Section and is a member of the Board of Directors for the Orange County Patent Law Association. Previously, Ms. Barker served as co-chair of AIPLA's Young Lawyers Committee, National Director of AIPLA's Women in IP Law dinners, was a member of AIPLA's Amicus Committee, and was vice-chair of the ABA IPL Section’s ADR committee.
Ms. Barker has written articles and contributed to books on patent litigation, alternative dispute resolution in intellectual property matters, injunctive relief, and patent reform. Before joining Howrey, Ms. Barker interned in all three branches of the U.S. government. She served as an intern in the White House Counsel’s office, completed a judicial externship with the Honorable Susan G. Braden with the U.S. Court of Federal Claims, and interned and served as a staff assistant for the United States Senate Subcommittee for International Security, Proliferation, and Federal Services. Ms. Barker also interned in the Gene Imprinting Unit at the National Institutes of Health. Ms. Barker obtained her J.D. degree from Georgetown University Law Center and her A.B. degree from Georgetown University. In 2009 and 2010 Ms. Barker was named a Southern California Super Lawyer Rising Star.
Representative Highlights
- Procter & Gamble Co. v. Fruit of the Earth Inc. Represented client in a case that resulted in a settlement and consent judgment on behalf of P&G in which FOTE agreed to revise its products and recognized P&G’s patents and trade dress.
- VUTEk, Inc. v. Leggett & Platt, Inc. Represented client in a declaratory judgment action. Successfully opposed motion to dismiss; drafted motion for summary judgment of invalidity in a continuation patent.
- Leggett & Platt, Inc. v. VUTEk, Inc. Drafted successful response brief persuading the Federal Circuit to uphold summary judgment of invalidity.
