Mindy Davis' practice is focused on litigation, especially complex business disputes.  Her experience includes class action defense, products liability, multidistrict litigation, insurance recovery and commercial contract disputes.  Ms. Davis has represented several industry leaders, including Amerada Hess, El Paso Corporation, The Coastal Corporation, ConocoPhillips, United Refining Company, Safety-Kleen Corporation and ChevronTexaco.

Ms. Davis currently represents several major oil refiners in over 50 products liability cases alleging environmental damage resulting from the gasoline additive MTBE.  These complex state and federal court cases have been consolidated by the Judicial Panel on Multidistrict Litigation and are now pending in the US District Court for the Southern District of New York.

Ms. Davis’ extensive policy holder insurance coverage practice includes coverage disputes for product liability, environmental, asbestos, construction and other large-scale tort claims.  She has significant experience in litigation and negotiation in federal and state courts throughout the country, as well as arbitration and mediation, including international arbitration in London and Bermuda.  Ms. Davis also advises on insurance-related issues regarding management of corporate risk, directors and officers liability policies and indemnity-related commercial litigation matters.

Ms. Davis is actively involved in Howrey firm management.  She currently serves on the firm's Advisory Board and the Associate Development Committee, and is the Chairman of the firm's Evaluation Committee.

Representative Highlights

  • Fuisz v. Selective Insurance Co. of America. Obtained a landmark decision from the United States Court of Appeals for the Fourth Circuit regarding an insurance company’s duty to defend defamation claims.
  • Four Star Oil & Gas Co. v. Allianz Insurance Co. Negotiated highly favorable settlements in a global environmental insurance coverage case with 75 of the case’s 80 defendants.
